Terms and Conditions

Draft Terms for Review Before Launch

This is a development draft for McGee Cosmo Products, Inc., doing business as My Melanine. Replace bracketed information and obtain review of the final terms before live sales. Acceptance of this draft in testing is recorded only for testing.

Accounts and Monthly Service

Provide accurate contact and delivery information and keep your account credentials secure. The checkout will display your box, chosen products, price, delivery charges and payment terms before confirmation. The current demonstration does not charge a card or activate recurring billing. Live renewal, annual plan, cancellation and gift terms must be added before subscriptions are offered.

Selections and Shipping Schedule

Our planned service uses weekly Friday purchasing and fulfillment batches. Your selection cutoff, payment status and expected shipment window will be displayed for your order. Supplier availability, unusual shades, holidays and failed payments can delay an order. A printed shipping label is not confirmation that the carrier has received the parcel; carrier pickup may occur on the following business day. We do not offer same day or next day delivery. Add the final cutoff time, shipping charges, delay notices, cancellation choices and return policy before launch.

Product Use and Manufacturer Responsibilities

Read product labels, ingredients, directions and warnings before use. Stop using a product if irritation occurs and seek appropriate advice. Manufacturer warranties, if any, remain the manufacturer’s responsibility. My Melanine does not voluntarily provide an additional manufacturer warranty unless expressly stated in writing.

To the extent permitted by applicable law, claims arising solely from a manufacturer’s defect should be directed to that manufacturer, and the customer agrees not to hold My Melanine responsible solely for conduct attributable to that manufacturer. This provision does not waive nonwaivable consumer rights, impose an indemnity for our own negligence or misconduct, or exclude liability that cannot lawfully be excluded. Any implied-warranty disclaimer, product liability limitation or damages cap must be finalized for the jurisdictions served.

Proposed Binding Arbitration Agreement

Subject to the final reviewed agreement, the parties agree to resolve covered disputes by binding individual arbitration rather than a court trial. The final agreement must identify the administrator and governing consumer rules, procedures for filing, allocation of costs, location or remote hearing options, available remedies, small claims and statutory exceptions, and any opt-out procedure. [Insert completed, reviewed arbitration agreement here.] This incomplete development paragraph must not be used as a final live arbitration clause.
